SHORT-TERM RENTAL AGREEMENT

Effective Date: January 1, 2026

This Short-Term Rental Agreement (“Rental Agreement”) is a legally binding contract between the Guest and the Host governing the stay at the Accommodation.

This Agreement is separate from the Platform Terms.


1. Contracting Parties

  • Host: South Atlantic Holdings / Property Owner
  • Guest: Individual completing the reservation and all occupants

The booking Guest is the responsible party.


2. Term of Stay

The Agreement applies only to the confirmed reservation dates.
No tenancy or leasehold interest is created.


3. Occupancy & Use

  • Accommodation may only be used for short-term lodging
  • Maximum occupancy limits must be observed
  • No parties or events unless approved in writing

4. Payments, Deposits & Charges

Guest authorizes Host to charge for:

  • Damage or missing items
  • Excessive cleaning
  • Rule violations
  • Unpaid fees

5. Cancellation & Refunds

The cancellation policy disclosed at booking governs this Agreement.


6. Maintenance & Entry

Host may enter the Accommodation when reasonably necessary for emergencies, repairs, or compliance.


7. Risk & Liability

Guest assumes ordinary risks associated with residential lodging and agrees to use the property responsibly.


8. Indemnification

Guest agrees to indemnify Host from claims arising from Guest conduct or violations.


9. Termination

Host may terminate the stay without refund where permitted by law for violations of this Agreement or the House Rules.


10. Governing Law

This Agreement is governed by the laws of the state of Washington.


 

HOUSE RULES

These House Rules apply to all Guests, occupants, and visitors during the stay.
Violation of these rules may result in fees, termination of the stay, or removal without refund where permitted by law.


1. Occupancy & Guest Limits

  • Maximum Occupancy: 5 overnight guests.
  • Additional Guests: Only guests included in the reservation are permitted to stay overnight.
    Additional overnight guests require prior written approval and may incur an additional nightly fee.
  • Unregistered Overnight Guests: Not permitted without approval.
  • Day Visitors: Daytime visitors are allowed provided they comply with all House Rules and do not stay overnight.

2. Check-In, Check-Out & Access

  • Check-In: After 4:00 PM
  • Check-Out: By 11:00 AM unless a late checkout has been approved in advance.
  • Smart Lock Access: Guests will receive a private access code.
    Do not share access codes under any circumstances.
  • Late Checkout: Subject to availability and approval.
    An additional fee of $65 may apply unless otherwise agreed in writing.

3. Entry & Door Use

  • Front Door:
    • Always close the screen door when exiting.
    • Do not lock the screen door from the outside to avoid lockouts.
  • Back Door:
    • For trash disposal only.
    • Backyard and rear garden areas are not accessible and must not be entered.
  • Lockouts: Guest-caused lockouts may result in service fees.

4. Shoes & Interior Care

  • Shoes Policy: No shoes inside the home.
    Shoes must be stored on the provided rack near the entry.
  • Complimentary slippers are provided for indoor use.

5. Quiet Hours & Neighborhood Conduct

  • Quiet Hours: 11:00 PM – 7:00 AM.
  • Guests must keep noise to a respectful level at all times.
  • Excessive noise, complaints, or disruptive behavior may result in immediate termination of the stay.

6. Smoking, Substances & Illegal Activity

  • No Smoking Indoors: Smoking or vaping of any kind is prohibited inside the home.
  • Designated Smoking Area: Smoking is permitted only in the designated outdoor courtyard area.
  • Illegal Activity: Strictly prohibited and grounds for immediate removal.

7. Pets

  • No Pets unless approved in writing prior to arrival.
  • Unauthorized pets may result in additional cleaning fees or termination of the stay.

8. Heating, Cooling & Utilities

  • In the bedrooms, use no more than two wall heaters at a time to avoid system overload. Use of both wall heaters in the living room at the same time is allowed. 
  • Set thermostats to 68°F prior to checkout.
  • Portable AC units and fans are provided seasonally and must be turned off at checkout.
  • Tampering with HVAC systems or electrical fixtures is prohibited.

9. Outdoor Areas

  • Guests may use the front porch and fenced front courtyard only.
  • Backyard and rear garden area are off limits and for private use of guests lodging in the private unit upstairs.
  • BBQ grill and firepit are available upon request and must be used only in designated areas.
  • No outdoor cooking or storage on the front porch.

10. Trash, Recycling & Disposal

  • Guests must follow posted recycling and compost instructions.
  • Trash must be properly sorted and placed in designated bins.
  • Garbage disposals must not be used for fibrous, greasy, or hard foods.
  • Failure to follow waste guidelines may result in additional cleaning fees.

11. Maintenance, Deliveries & Access

  • No Personal Mail or Package Deliveries:
    Guests may not have personal packages or mail delivered to the property.
  • Maintenance Deliveries:
    Maintenance or supply deliveries may occur during the stay. Guests must leave such packages untouched on the porch.
  • Emergency Entry:
    Host reserves the right to enter the property when reasonably necessary for safety, maintenance, or emergency purposes.

12. Property Care & Safety

  • Do not rearrange furniture or add locks.
  • Do not disable safety devices.
  • No flammable items, signage, or advertising permitted.
  • Report damage or appliance issues promptly.

13. Office & Convertible Space

  • Office space may be converted into a bedroom with 72 hours’ notice and approval.
  • Additional guest fees apply where applicable.

14. Checkout Responsibilities

Guests agree to:

  1. Place used towels, white bedsheets and pillow cases in the hamper
  2. Run the dishwasher
  3. Dispose of trash properly
  4. Secure doors and windows
  5. Reset thermostat and turn off AC units

Failure to complete checkout steps may result in additional fees.


 

DAMAGE WAIVER & DAMAGE RESPONSIBILITY

Accidental Damage Coverage

The reservation includes limited accidental damage coverage (“Damage Waiver”) for minor, unintentional damage occurring during the stay, subject to the following:

  • Coverage applies only to minor accidental damage
  • Coverage does not include:
  • Excessive cleaning
    • Unauthorized pets
    • Smoking violations
    • Theft or missing items
    • Intentional or reckless damage
  • Coverage is limited to minor repairs only and does not replace Guest responsibility

Guest Responsibility

Guests remain fully responsible for:

  • Damage exceeding the coverage amount
  • Intentional damage
  • Damage caused by violations of House Rules
  • Damage caused by guests or visitors

Host may charge the payment method on file for documented costs.


 

ARBITRATION & CLASS-ACTION WAIVER

PLEASE READ CAREFULLY. THIS AFFECTS YOUR LEGAL RIGHTS.

Any dispute arising out of or relating to:

  • the Platform Terms, or
  • use of the booking website

shall be resolved by binding arbitration, except for claims eligible for small-claims court.

Arbitration Terms

  • Administrator: American Arbitration Association (AAA)
  • Rules: AAA Consumer Arbitration Rules
  • Location: King County, Washington (or virtual, if permitted)
  • Costs: Each party bears its own legal fees unless otherwise awarded by the arbitrator

Class-Action Waiver

You agree that:

  • All disputes must be brought in your individual capacity
  • You waive the right to participate in any class, collective, or representative action

This clause does not apply to disputes governed solely by the Short-Term Rental Agreement, which are governed by local law where the property is located.
